Article 1 – Definitions
In these Terms and Conditions, the following definitions apply:
Cooling-off period: the period within which the consumer may exercise their right of withdrawal.
Consumer: a natural person not acting in the course of a profession or business who enters into a distance agreement with the trader.
Day: a calendar day.
Continuous transaction: a distance contract relating to a series of products and/or services, where the delivery and/or purchase obligation is spread over time.
Durable data carrier: any tool that enables the consumer or trader to store information addressed personally to them in a way that allows future reference and unaltered reproduction of the stored information.
Right of withdrawal: the consumer’s option to withdraw from the distance contract within the cooling-off period.
Trader: the natural or legal person offering products and/or services to consumers at a distance.
Distance contract: a contract concluded within the framework of a system organised by the trader for distance sales of products and/or services, whereby up to and including the conclusion of the contract, exclusive use is made of one or more means of distance communication.
Means of distance communication: any means that can be used to conclude an agreement without the consumer and trader being physically present in the same place at the same time.
Terms and Conditions: these Terms and Conditions of the trader.

Article 3 – Applicability
These Terms and Conditions apply to every offer from the trader and to any distance contract concluded between the trader and the consumer.
Before the distance contract is concluded, the text of these Terms and Conditions will be made available to the consumer. If this is not reasonably possible, the trader will indicate where the Terms and Conditions can be inspected and that they will be sent free of charge upon request.
If the distance contract is concluded electronically, the text of these Terms and Conditions may be supplied electronically in such a way that the consumer can easily store it on a durable data carrier.
In the event that special product or service terms apply in addition to these general Terms and Conditions, the consumer may always rely on the provision most favourable to them in the event of conflict.
If any provision of these Terms and Conditions is found to be void or invalid, the remaining provisions will continue to apply.
Article 4 – The Offer
If an offer is subject to limited validity or conditions, this will be clearly stated.
All offers are non-binding; the trader reserves the right to amend or withdraw offers.
The offer contains a complete and accurate description of the products and/or services offered. The images and descriptions are intended to present products as truthfully as possible. Minor variations or obvious errors do not bind the trader.
Every offer will clearly state the rights and obligations attached to acceptance of the offer, including:

The price (excluding import VAT and customs clearance fees, which remain the responsibility of the customer);

Delivery costs, if applicable;

The method of payment, delivery and performance;

The right or exclusion of withdrawal;

Article 5 – The Contract
The contract is concluded at the moment the consumer accepts the offer and meets the stated conditions.
If the consumer accepts the offer electronically, the trader will promptly confirm receipt of acceptance. Until this confirmation is received, the consumer may dissolve the contract.
The trader will take appropriate technical and organisational measures to secure electronic data transmission and payments.
If the trader has valid grounds to suspect non-payment, they may refuse an order or impose additional conditions.
The trader will include with the product or service the following information in writing or electronically:

Contact address for complaints;

Terms and method for exercising the right of withdrawal;

Information about warranties and after-sales service;

These Terms and Conditions (if not already provided).
Article 6 – Right of Withdrawal
The consumer has the right to withdraw from the contract within 14 days without giving any reason.
This cooling-off period starts on the day after the consumer or a third party designated by them receives the product.
During the cooling-off period, the consumer shall handle the product and packaging carefully and only inspect it as necessary to establish its nature and functioning.
Article 7 – Costs in Case of Withdrawal
If the consumer exercises the right of withdrawal, return shipping costs are at the consumer’s expense.
If the consumer has already paid, the trader will refund the amount within 14 days after withdrawal, provided the returned product has been received or sufficient proof of return has been provided.
Article 8 – Exclusion of Withdrawal Right
The trader may exclude the right of withdrawal for:

Products made to the consumer’s specifications;

Personalised or perishable goods;

Sealed hygiene items once unsealed;

Audio/video recordings or software once unsealed;
-
Services that have begun with the consumer’s explicit consent before the cooling-off period has expired.
Article 9 – Price
Prices will not increase during the offer period, except for VAT or legal changes.
All prices are in GBP (£) and exclude import duties and clearance costs (if applicable).
Obvious misprints or errors are not binding.
Article 10 – Conformity and Warranty
The trader guarantees that the products meet the contract, reasonable expectations, and legal requirements.
Defective or incorrectly delivered items must be reported within 14 days of delivery.
The warranty corresponds to the manufacturer’s warranty. The trader is not liable for misuse, normal wear, or improper handling.
Article 11 – Delivery and Execution
The trader will exercise the greatest care when receiving and fulfilling product orders.
Delivery will take place at the address provided by the consumer.
Orders are usually processed within 1–2 business days and delivered within 2–4 business days.
If delivery is delayed or a product is unavailable, the consumer will be informed within 30 days and may cancel the order for a full refund.
The trader bears the risk of loss or damage until delivery.
Article 12 – Duration Transactions
The consumer may terminate continuous contracts with a notice period of one month.
Contracts of fixed duration will not be automatically renewed.
Article 13 – Payment
Unless otherwise agreed, payments must be made within 7 working days after the start of the cooling-off period.
The consumer must report any inaccuracies in payment details immediately.
In case of non-payment, the trader may recover reasonable administrative costs.
Article 14 – Complaints Procedure
Complaints must be submitted within 7 days of discovering the issue via Support@vibedistrict.uk
The trader will respond within 14 days.
If more time is required, the consumer will be notified accordingly.
If a complaint cannot be resolved amicably, the dispute will be subject to the laws of England and Wales.
Article 15 – Applicable Law
All agreements between the trader and consumer are governed exclusively by English law.
Article 16 – CESOP Compliance
Under the 2024 EU directive concerning the Central Electronic System of Payment Information (CESOP), payment service providers may record certain transaction details for EU VAT compliance.
